Skattverket vill täppa till kryphål för räntesnurror

Skatteverket föreslår i en hemställan till regeringen vissa begränsningar i företags avdragsrätt för koncerninterna ränteutgifter. Bakgrunden är att Skatteverket har identifierat ett antal koncerninterna skatteplaneringsförfaranden där ränteintäkter redovisas i skatteparadis samtidigt som ränteutgifter dras av i Sverige, vilket medför en stor skattefördel (s.k. räntesnurror).


Skatteverket har tidigare försökt hindra denna typ av ränteavdrag med stöd av skatteflyktslagen. Regeringsrätten har dock i de s.k. Industrivärden-domarna förra året underkänt tillämpningen av skatteflyktslagen i dessa fall.

Skatteverket föreslår att ränteutgifter som betalas till bolag inom samma intressegemenskap under vissa förutsättningar inte får dras av. Reglerna omfattar bl.a. skulder som uppkommit i samband med koncerninterna förvärv av näringsbetingade andelar.

- Det är viktigt att motverka den här formen av skatteplanering eftersom skattepengarna finansierar vår välfärd. Det är inte acceptabelt att företag som betalar sina skatter får nackdelar jämfört med konkurrenter som agerar tvivelaktigt, säger finansminister Anders Borg.

Enligt Skatteverkets uppskattningar innebär den här typen av förfaranden ett avsevärt skattebortfall om ca 7 miljarder kronor per år. Regeringen har ännu inte tagit ställning till förslaget, men om det genomförs bör de ökade skatteintäkterna användas för att på annat sätt sänka företagens skattebelastning.

Skatteverkets förslag kommer nu att skickas ut på remiss.
